JOHN C. MILLIGAN-WHYTE, J.P.  

John Milligan-Whyte was born Altadena, California on February 17, 1952. He was called to the Bar in Ontario, Canada in 1984. John Milligan-Whyte was called to the Bar in Bermuda in 1985.

EDUCATION: John Milligan-Whyte graduated from The University of Toronto with a Bachelor of Arts degree with Honours in 1975. He attended the Queen's University Law School in Kingston, Ontario and graduated with a Bachelor of Laws degree in 1981. John attended the Osgoode Hall Law School in Toronto and graduated with a Masters of Law degree in 1987. John did Postgraduate Research at Harvard Law School and The Harvard Business School and was awarded the Osgoode Competition Fellowship award, Graduate Assistantship and elected to Faculty Council at Osgoode Hall Law School from 1982-1983. John Milligan-Whyte was a teaching Assistant from 1975-1976 and a Don from 1978-1981 at Queen's University, Ontario, Canada.

PROFESSIONAL EXPERIENCE: Articled with Fraser & Beatty, Toronto, 1982-1983, seconded to Herbert Smith & Co., Solicitors of London, England; Member of United States National Association of Insurance Commissioners' (NAIC¡®LC) Rehabilitators' and Liquidators' Task Force Advisory Committee and Subcommittee Redrafting NAIC¡®LC Insurers Supervision, Rehabilitation and Liquidation Model Act; Elected Vice-Chairman of the Committee on Public Regulation of Insurance Law of the Tort and Insurance Practice Section of the American Bar Association, 1988-1991; Chairman of the Committee advising Bermuda's Minister of Finance on Insurance, Reinsurance and Insolvency Law Reform, 1988-1889; Member of the Bermuda Law Reform Committee and Bermuda Law Reform Subcommittee on Bankruptcy; Member of International Association of Defense Counsel; Member of The Bermuda Bar Council Subcommittee on the Rules of Professional Conduct.   

ORLANDO SMITH  

Orlando Smith was born in Bermuda on September 22, 1952. He was admitted to The Bar in Georgia in 1977 and called to the Bar in Ontario, Canada and Bermuda in 1984.  

EDUCATION: Orlando Smith graduated from Howard University with a Bachelor of Science. He graduated from Emory University School of Law with a Juris Doctorate in 1977. Orlando attended The Osgoode Hall Law School and received a Certificate of Canadian Qualification in 1982.  

PROFESSIONAL EXPERIENCE: Articled with B. Levinter Q.C., Toronto specializing in Insurance Law from 1982-1983; Formerly with Registrar of Companies Department, Government of Bermuda from 1977-1980; Acting Registrar of Companies; Assistant Official Receiver for Bermuda, 1978-1980; Formerly employed by American International Group and Trenwick Re. Author: "Which Reinsurance Agreements are Enforceable Now?",Reinsurance Magazine, December 1984 Appointed Member: Committee Advising Bermuda's Minister of Finance on Insurance, Reinsurance and Insolvency Law Reform; Bermuda Bar Council Sub-Committee on Pupilage Rules; Bermuda College Board of Governors. Orlando specializes in insurance law, conveyance, estate planning and trusts.

TIMOTHY E.G. FELLOWES, Q.C. ACIArb

Timothy Fellowes was born in Winnipeg, Canada, June 3, 1927 and admitted to the Law Society of Upper Canada as a Barrister in 1954. Mr. Fellowes is certified as a specialist in civil litigation and is a member of the Advocates Society of Ontario. Mr Fellowes has specialized in insurance and reinsurance litigation and has been specially recognized by Courts in Ontario, Canada as being knowledgeable in insurance matters. Mr. Fellowes was appointed as one of Her Majesty¡¯s Counsel in 1969. He is a member of the Bermuda Bar and has also been called to the Bars of British Columbia, Turks & Caicos, Prince Edward Island and the province of Manitoba for special cases.

EDUCATION: Mr. Fellowes graduated with a Bachelor of Arts degree from University of Manitoba in 1950 and Osgoode Hall Law School, Canada in 1954. He is a life member of the Royal Canadian Military Institute, Toronto and was seconded from the Canadian Intelligence Judge Advocate General¡¯s Corps Branch from 1952-1954. Mr. Fellowes taught military law from 1948 ¨C 1956 while in the reserve and regular forces of the Armed Forces.

PROFESSIONAL EXPERIENCE: He has lectured in continuing legal education proceedings in Canada and Bermuda. He had formed his own law firm in 1954. He subsequently accepted various partners. Mr. Fellowes had a sole practice from 1972-1989 and then formed Fellowes & McNeil until 1995 in Toronto, Canada. He was a member of the Advocates Society, Ontario and was Chairman of their Committee on developing alternate dispute resolution, reporting to the Attorney General of Ontario. Mr. Fellowes has sat as both a mediator and arbitrator on private arbitrations and on Court pre-trial procedures. He is a member of the Chartered Institute of Arbitrators in London, England and in Bermuda. His specialty areas are insurance, corporate and commercial litigation and arbitration. n

LESLEY E. BASDEN - Associate  

EDUCATION: Lesley Basden was educated at Trent University, Peterborough, Ontario, Canada where she obtained her Bachelor of Arts degree in English and History in 1989. She holds a Bachelor of Laws degree from The University of Reading, Reading, England which she obtained in 1994. Ms. Basden was enrolled as a Member of the Law Society in England and Wales in 1995. She is a member of The Sexual Assault Prosecutions section of The American Bar Association. She has attended The World Women¡¯s Lawyer Conference in the United Kingdom in 2001, The Mealey Insurance Insolvency & Reinsurance Roundtable in the USA in 2002, and The Stitt Feld Handy Group ADR Workshop in Bermuda in 2002. PUPILAGE: Attorney General¡¯s Chambers, Hamilton, Bermuda (1995-1996). Her training included working in Drafting, Criminal and Civil Department of the Attorney General¡¯s Chambers. School for Prosecutors, Ottawa, Canada (1998).

PROFESSIONAL EXPERIENCE: Ms. Basden was enrolled as Barrister and Attorney in the Islands of Bermuda in 1996 and served as Crown Counsel for the Attorney General of Bermuda and subsequently the Department of Public Prosecutions, Hamilton, Bermuda from 1996-1999. Her responsibilities included conducting Criminal Prosecutions and Appeals in all Courts of Bermuda and providing legal advice to various Government Ministries, Government Departments and Tribunals on matters relating to inter alia, Civil and Criminal Law and International and National Legislation. Ms. Basden has been an Associate Commercial litigator with Milligan-Whyte & Smith since 1999. Her responsibilities include Conduct of International Commercial litigation matters with emphasis on insolvency cases.   Sharon Morgan-Suessm -  Pupil Practice Areas: Civil & Commercial Litigation and Insolvency Law Sharon Morgan-Suess is a Pupil within the firm. She trains under the mastership of the senior partners and of counsel to the firm after completing the Post Graduate Diploma in 2002. Sharon joined the firm in January 2003 and will complete her pupilage at the end of December 2003. Sharon was educated in Bermuda, the United States and finally in the United Kingdom, at the University of Hull, and obtained an LLB Honors in 1998 She Joined the Firm of Appleby Spurling & Kempe as a Law Student training in the area of Securities and Finances from 1999 until 2001, after which she attended the University of Northumbria in Newcastle in the United Kingdom to complete the Post Graduate Diploma in Legal Practice.

Sharon Morgan-Suess is a corporate attoney within the firm. She completed the Post Graduate Diploma in 2002.Sharon joined the firm in January 2003.

Sharon was educated in Bermuda, the United States and finally in the United Kingdom, at the University of Hull, and obtained an LLB Honors in 1998. She Joined the Firm of Appleby Spurling & Kempe as a Law Student training in the area of Securities and Finances from 1999 until 2001, after which she attended the University of Northumbria in Newcastle in the United Kingdom to complete the Post Graduate Diploma in Legal Practice.

DAI MIN 

Dai Min is the director of business development of Milligan-Whyte & Smith, Co-chair and Founder of The China Bermuda Society and President of China Bermuda Management Ltd. China Bermuda Management is the successor firm of DMS Group Inc, which Dai Min founded in 1993 to assist Western clients such as ABB Switzerland and BASF Germany in their business development activities in China. Dai Min has assisted Chinese Government clients such as the State Commission on Economic Restructuring, The State Commission on Economic Planning, The Ministry of Science and Technology, The Chinese International Chamber of Commerce and major banks. Dai Min also has extensive clients and relationships with Provincial Governments, Municipal Governments and with major Chinese securities firms, government and privately owned businesses and investors. Earlier in her business career, Dai Min worked for an American company selling real estate in South America to Asian investors, for the United Nations in New York coordinating visiting Chinese Government Officials¡¯ and business executives¡¯ itineraries, as a currency trader on Wall Street and as a Television Producer in New York. In 1978 Dai Min won the first National Talent Competition For The Performing Arts in China and preformed as a Lyric Soprano with the National Opera and Dance Company in Beijing and throughout China from 1978 to 1985. Dai Min grew up in Hunan Province in Mainland China during the Cultural Revolution and studied Voice and Opera at Beijing Conservatory and with Professor Stalberg in Berlin, the Elizabeth Studio in London and the University of Texas. She is the granddaughter of General Dai Feng-Xiang, Chief Military Commander of the Hunan Province during the Republican Era, who supported Sun Ya-Sun, the founding father of China, to overthrow the Qi Dynasty. General Dai Feng-xiang was honored for his support of Sun Ya-Sun by both the Gou-ming-dang and Communist Governments before and after 1949. Her Grandfathers were generals in pre-revolutionary China. Her parents live in Hunan and her sisters in Germany and America.  

NOREEN JANG - ACCOUNTANT

Noreen Jang is an accountant for the firm. She conducts audits, handles tax matters, financial statement preparation, payroll, billing and collections. Noreen joined the firm in May 2003. Prior to that, she was a senior fund accountant at Hemisphere Management Ltd. in Bermuda for two years and Reid Hurst, Nagy CGAs for three years as a staff accountant. Noreen was educated in Canada, where she studied at University of Columbia, graduating in 1994. She also graduated from the British Columbia Institute of Technology in 1996 with a Diploma in Financial Management. Noreen obtained her Certified General Accountant professional designation in 2002.
